Terms of use

These terms are an agreement between you and Eynon Software, LLC, an Ohio limited liability company ("we", "us"), about using the Learning Breaks app and this website. They are written for the parents, carers and teachers who install and set up Learning Breaks. Game developers who use the developer portal also agree to the publisher agreement, which governs their games, listings and earnings.

1. Who can use Learning Breaks

You must be an adult to install and set up Learning Breaks, create a grown-up account, or use the Grown-ups area of the app. Children use Learning Breaks under your supervision, through the profiles you set up for them. By setting it up for a child, you confirm you are their parent or carer, or are otherwise allowed to make this decision for them, such as their teacher acting for their school.

2. What Learning Breaks does

Learning Breaks lets games that work with it show a short practice break instead of an advert, and lets some games offer a reward for finishing a practice break. It also lets you create practice from spelling lists, maths and photographed homework. Breaks always end, and a child is never penalised in a game for how a break went.

Learning Breaks is a practice tool. We work hard to make it accurate and helpful, but we don't promise any particular educational result, and it is not a replacement for a child's teacher.

3. Games made by others

Games that work with Learning Breaks are made by other companies, under their own terms and privacy policies. We review every game before it can give breaks in a released version and act on reports from parents, but we do not make these games and are not responsible for their content, purchases or advertising. If a game worries you, report it from the app, and we will look at it.

4. Content you add

You are responsible for the spelling lists, maths, photographs and class names you add. Please only photograph worksheets you are allowed to use for your child's or your class's learning, and don't put anyone's personal information into a list, a class name or a photo. A class's seats are named by us, and there is nowhere to enter a child's name. You keep any rights you have in what you add, and you let us process it only as needed to run Learning Breaks for you, as described in our privacy policy.

5. Practice made with AI

When you photograph a worksheet or ask for example sentences, the result is produced by an AI service and can be wrong. It is shown to you in the Grown-ups area before your child uses it; please check it. Children never use the AI features directly.

6. Using Learning Breaks fairly

You agree not to:

We may suspend access to our server from an install, a class or an account that breaks these terms, and we will explain why when we can.

7. Price

If we offer paid plans, the price and what it includes will be shown clearly before you are asked to pay, and payment will be handled by the app store you install Learning Breaks from, under its terms. Nothing is charged without your agreement.

8. Changes and availability

We keep improving Learning Breaks, so features may change. We try to keep our server available but cannot promise it will always be; when it can't be reached, games simply show what they would have shown without Learning Breaks. We may update these terms. If a change is significant, we will update the date above before it takes effect, and continuing to use Learning Breaks after that means you accept the new terms.

9. Ending

You can stop using Learning Breaks at any time by removing the app. You can also delete what our server holds, as described on our delete my data page. We may stop providing Learning Breaks, and if we do we will give reasonable notice where we can.

10. Our responsibility

Learning Breaks is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, or for games made by others, and our total liability to you is limited to the amount you have paid us in the twelve months before the claim. Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement.

11. Governing law

These terms are governed by the laws of the State of Ohio, United States, and any dispute about them or about Learning Breaks will be heard in the state or federal courts located in Ohio. This does not take away any right you have to bring a claim where you live under consumer protection law that cannot be limited by agreement.
